Terms of Service

1. Agreement to these terms

These Terms of Service govern your access to and use of TKNMart, including the website, account dashboard, API keys, model catalog, billing tools, API gateway, and related services. By creating an account, requesting access, purchasing credits, generating an API key, or using the API, you agree to these terms.

2. Private beta and approved access

TKNMart is currently provided as a private beta service for approved customers. We may approve, deny, suspend, limit, or revoke access at any time to protect the service, upstream providers, other customers, legal compliance, or platform security.

3. Your account, API keys, and users

You are responsible for all activity under your account, API keys, team members, systems, agents, tools, and integrations. Keep API keys confidential, use appropriate access controls, and notify us promptly if a key is lost, leaked, misused, or compromised.

4. Customer content and data you submit

Prompts, messages, files, images, code, metadata, outputs, and other materials you or your users submit through TKNMart are your responsibility. You represent that you have the rights, permissions, notices, and consents required to submit that content, including where it contains personal data, confidential information, regulated data, customer data, employee data, or third-party content.

5. Processing and routing instructions

When you send content through TKNMart, you instruct us to process, transmit, route, receive, and retain limited request content as needed to provide, bill, secure, support, and audit the requested API service. Authorized TKNMart administrators may review retained customer-authored request text for account support, billing investigation, security, abuse prevention, dispute resolution, and legal compliance. This may also include sending content and request metadata to upstream model providers, infrastructure providers, payment processors, fraud-prevention services, analytics systems, monitoring tools, and other service providers that support the platform.

6. Upstream model providers

TKNMart routes requests to third-party model providers and related services. Those providers may process, retain, filter, moderate, log, or use content according to their own terms, privacy policies, API policies, data retention settings, abuse-prevention rules, and enterprise settings. You are responsible for selecting models and providers suitable for your use case and data sensitivity.

7. Prohibited use

You may not use TKNMart for unlawful activity, abuse, malware, credential theft, spam, evasion, harassment, exploitation, illegal surveillance, infringement, deceptive impersonation, unauthorized scraping, high-risk decisions without required safeguards, or any use that violates applicable law, upstream provider policies, payment-network rules, or our reasonable safety and abuse-prevention requirements.

8. Billing, credits, and usage charges

Usage is billed according to the model, provider route, token usage, image usage, minimum charge, and pricing configured in TKNMart at the time of use. Recharge purchases are final and non-refundable once credited, except to the extent a refund or other remedy is required by applicable law. Purchased and promotional credits have no cash value, cannot be withdrawn, redeemed for cash, sold, assigned, or transferred between accounts, and may be used only for future TKNMart services. Credits do not expire merely because of account inactivity. We may suspend access to credits, reverse improperly obtained promotional credits, correct billing errors, or offset amounts connected with fraud, abuse, duplicate credits, payment reversals, or chargebacks. Suspension or termination for a breach does not create a refund entitlement except where required by law. You are responsible for monitoring balances, API keys, usage, limits, pricing, and auto-recharge settings.

9. Outputs and responsibility

AI outputs may be inaccurate, incomplete, unsafe, offensive, infringing, or unsuitable for your intended use. You are responsible for reviewing, testing, validating, and supervising outputs before relying on them or sharing them with others. TKNMart does not provide legal, medical, financial, professional, or safety-critical advice.

10. Suspension and termination

We may suspend or terminate accounts, API keys, requests, model access, or payments if we believe there is abuse, security risk, legal risk, non-payment, policy violation, upstream-provider issue, chargeback risk, or conduct that may harm TKNMart, providers, users, or the public.

11. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless TKNMart, its operators, affiliates, service providers, and personnel from claims, losses, liabilities, damages, penalties, costs, and expenses arising from your content, users, API activity, products, integrations, breach of these terms, violation of law, infringement, data misuse, or unauthorized use of the service.

12. Disclaimers and limitation of liability

TKNMart is provided on an as-is and as-available basis. We do not guarantee uninterrupted service, model availability, provider access, specific outputs, response quality, uptime, latency, pricing continuity, or compatibility with every client. To the fullest extent permitted by law, TKNMart will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost-profit, lost-data, business-interruption, or provider-related damages.

13. Changes

We may update these terms, privacy practices, pricing, features, providers, and policies from time to time. Continued use of TKNMart after changes become effective means you accept the updated terms.

Privacy Policy

Privacy and Data Handling

1. Information we collect

We may collect account details, email addresses, names, login/session data, API key metadata, wallet and payment metadata, billing records, usage events, model selections, token counts, request status, timestamps, IP addresses, device/browser information, support messages, and operational logs.

2. API content

TKNMart stores a limited encrypted copy of customer-authored text from successful API requests for up to 30 days by default. This content is available only through an administrator-authenticated request-audit function and may be reviewed for account support, billing investigation, security, abuse prevention, dispute resolution, debugging, reliability, or legal compliance. Stored excerpts are capped in length, credential-like values are redacted where detected, and model outputs are not included in this request-audit record. Messages and generated images that customers save in the TKNMart chat workspace are retained separately as customer-visible conversation history until the customer deletes the conversation or the account or service is terminated. API content also passes through our systems in transit and may be processed or retained separately by upstream model providers under their policies.

3. How we use information

We use information to provide the service, authenticate users and API keys, route requests, calculate usage and pricing, process payments, detect abuse, enforce limits, maintain security, provide support, improve reliability, comply with law, communicate with customers, and operate the private beta.

4. Sharing with providers and processors

We share information with upstream model providers and service providers only as needed to operate TKNMart, including model inference, infrastructure, hosting, monitoring, payments, email, analytics, fraud prevention, and legal compliance. Upstream providers may have their own data retention and use policies, and those policies may vary by provider, model, region, plan, and account setting.

5. Your responsibility for personal and confidential data

You are responsible for deciding what data you and your users send to TKNMart. Do not submit personal data, confidential data, regulated data, secrets, credentials, source code, customer records, health information, financial information, or sensitive material unless you have authority to do so and have assessed whether the selected model and provider are appropriate.

6. Security

We use reasonable administrative, technical, and organizational safeguards for the service. No internet or API service is perfectly secure. You are responsible for securing your account, API keys, client systems, user permissions, logs, and downstream applications.

7. Retention

We retain encrypted customer-authored request excerpts for up to 30 days by default and automatically delete them after their recorded expiry time. Customer chat workspace conversations and generated images are retained until the customer deletes the applicable conversation or the account or service is terminated, subject to storage and message limits. We retain account, billing, wallet, payment, API key metadata, administrator access logs, and usage records for as long as needed to provide the service, meet legal obligations, resolve disputes, enforce agreements, prevent abuse, and maintain financial records. Retention of content handled by upstream providers is governed by their applicable policies and settings.

8. International processing

TKNMart and its providers may process information in multiple countries. By using the service, you understand that data may be transferred to and processed in jurisdictions different from your location or your users' locations.

9. User requests

You may contact us to request access, correction, deletion, or export of account information where required by applicable law. We may need to verify your identity and may retain records where necessary for billing, security, legal compliance, dispute resolution, or abuse prevention.
